LD provides this site as a useful resource for diamond shopping, and a retail location for certified loose diamonds and fine jewellery. These are the terms of use for our website for orders shipping to addresses in the South Africa, Botswana, Mozambique, Namibia, Zambia, Tanzania, Malawi, Lesotho, Swaziland, Mauritius, Madagascar, United Kingdom, Australia, New Zealand, Hong Kong.

Suspected Violations of these Terms and Conditions or Unauthorised Uses 
You shall promptly notify Louie Daniele  and the company, organisation, institution with which you are affiliated, or whose facilities you are using, of any known or suspected unauthorised use(s) of your account or the LD Website, or any known or suspected breach of security, including loss, theft, or unauthorised disclosure or use of your username, password, and/or IP address. Any use of the LD website beyond the scope or in violation of these Terms and Conditions of Use, knowing use of any password or username of another, or any fraudulent, abusive, or otherwise illegal activity, may be grounds for termination of your account, or termination of access to the LD website from your IP address, without notice and at Louie Daniele 's sole discretion. You are advised to purchase as per your own discretion. Service, Product & Certificate Information 
We, at Louie Daniele, make every attempt to ensure that our online services, product & certificate information is as accurate, reliable and complete as possible. We attempt to describe in detail the product specifications and/or services we offer but in some cases the actual product specification and/or services offered and delivered may differ from the online information, as we are continuously changing, modifying and improving our product & services.

Louie Daniele  prepares certificates and reports in accordance with generally accepted gemological standards and grading techniques used at the time of the examination and makes no warranty or representation regarding any certificate or report. LD’s report shall not be regarded as a warranty of grading characteristics.

Most natural gemstones are treated or enhanced to intensify color, diminish imperfections and improve durability.

Diamond Certificates. When you order a loose diamond or custom-built jewellery, we ship it to you with the accompanying diamond grading report (also called a diamond certificate). These grading reports are detailed documents created by diamond grading experts at one of two highly-respected diamond grading laboratories - making it very expensive to replace a diamond grading report. Because of this, we require each diamond grading report to be included with each returned diamond.
If you do not include both the diamond grading report and appraisal with your return, you will be charged a replacement fee. 
Diamonds from Southern Africa. We are happy to provide a broad range of high-quality conflict-free diamonds from Southern African sources.

Policy on Conflict Diamonds
At LD, we only purchase diamonds through the largest and most respected suppliers who, like us, proudly adhere to and enforce the standards established by the Kimberley Process, an international system that police’s the trade of diamonds to ensure they are from sources free of conflict. Indemnification
You agree to indemnify, defend, and hold harmless, Louie Daniele , its affiliates, parents, and their respective officers, directors, employees, agents, licensors, representatives, and third party providers to the Website from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this agreement by you. Louie Daniele  reserves the right to assume, at its sole expense, the exclusive defense and control of any matter subject to indemnification by you, in which event you will fully cooperate with Louie Daniele  in asserting any available defenses.

Jurisdiction and Governing Law
This Website is controlled and operated by Louie Daniele  from its office in Pretoria, Gauteng, South Africa and in conjunction with our Website Licensors and third party service providers. This Website can be accessed from other locations. By accessing this Website, you agree that these Terms of Use shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to its conflicts of law principles. You also consent to personal jurisdiction in Pretoria in the Republic of South Africa for any dispute arising hereunder. Product and Availability, Pricing
You may choose to view pricing and complete your order in any one of the following currencies: South African Rand, British pound, Euro and United States Dollar. 
If you're interested in a piece of jewellery that is currently on backorder, call us and we can tell you when the item will be back in stock. Sometimes with the volume of orders we receive, an item can go out of stock before we're able to post notification to the site. If this happens, we will notify you personally so we can help you find another item.
Infrequently, data (including prices) may be inaccurately displayed on our site due to system or typographical errors. While we make every attempt to avoid these errors, they may occur. We reserve the right to correct any and all errors when they do occur and we do not honour inaccurate or erroneous prices. If a product's listed price is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. Our prices are also subject to change without notice and subject to changes in global commodity prices. We apologise for any inconvenience that this may cause. International Shipments
Purchases made through our South African website may be shipped to addresses in Southern Africa and other African countries, Madagascar, Mauritius, the United Kingdom, Austria, Belgium, Bulgaria, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.

Importer of Record
When ordering from LD, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Title and risk of loss for items ordered will transfer to the recipient upon delivery to the common carrier in the destination country.
Prior to delivery to the recipient, the shipment may be subject to customs fees, import duties, taxes, and other charges of the destination country where applicable. These charges are always the recipient's responsibility. For further details, read about Customs, Duties and Taxes.

Customs, Duties and Taxes
The customs office of the destination country may impose customs fees, import duties, taxes, and other charges to your international order where applicable. These additional charges required for customs clearance are the responsibility of the recipient. When your order arrives at customs either our shipper, or the customs office will contact you directly to arrange for the payment of any charges that may be due.
The table below shows estimated duty and tax rates. Please be advised that LD has no control over these charges. The actual amount charged by customs may differ from the rates below. Country of origin information for your order can be provided by our Diamond and Jewellery Professionals to assist in estimating import duties. Please contact your local customs office for further details.

Value Added Tax (VAT)
Value added tax (VAT) will be applied for all orders placed on the South African website and delivered within the borders of South Africa. The VAT amount is calculated based on the current VAT percentage as indicated by the law of South Africa.  Please note that this charge will appear in the shopping basket after you have entered a shipping destination. 
No (zero)  Value added tax (VAT) will be applied to orders placed on the South African website and delivered outside the borders of South Africa. However, taxes, and other charges of the destination country may be applicable. 
The South African Revenue Services (SARS)  VAT Retail Export Scheme further allows the VAT amount to be reimbursed to customers when they purchase goods in the South Africa and then export them outside SA. 

Payment 
For your convenience, we accept the following payment methods: 
Credit cards: Use your Visa, MasterCard, Diners Club or American Express credit card.
Bank wire: Arrange payment through your bank and receive a 1.5% discount. Goods will only be released upon authentic verified proof of funds in the bank account of LD. 
For orders under ZAR 150,000 or EUR 15,000 or GBP 10,000, we accept Paypal payment.
EFT (electronic funds transfer) 
“LD Finance” a Mobicred financial service. 

Note that orders shipping to International destinations outside South Africa will need to have a minimum order value of ZAR 10,000.00

Delivery and Insurance
Insurance and Risk 
All shipments are fully insured. That means that your order is always shipped risk-free. 
For orders shipping to the international countries the delivery insurance (or asset protection) will be provided by a premier global shipping company. A fee of 0.20% of the value of your order will be applied during the checkout process. This insurance protects your order from the time it leaves LD to when it arrives at your door. This policy is an agreement between the customer and the shipping insurance company. Details about the shipping insurance company and claims process will be provided to you, following your purchase, in your order confirmation email.
For added security, a signature may be required upon delivery of your LD order. Please make arrangements for someone to be available at the shipping destination to sign for receipt.

Alternate Shipping Addresses
If you prefer, we can ship your order to an address other than your billing address. As a security precaution, we require that your alternate shipping address be on file with your credit card company. This step helps protect you from fraudulent charges to your credit card.

Order Cancellation & Return Policy
LD offers customers 7 days from the day their order is shipped to cancel or return their order. If you wish to cancel or return your purchase, simply call a diamond and jewellery professional at online@louiedaniele.com or dial +27 87-700-1170 (Customer Service hours: Weekdays 9:00 – 17:00)  
The customer only pays return shipping fees. 
Note that once your item has shipped, your order cancellation will take effect after a) it is returned to LD, and b) our Quality Assurance analysis your diamond and verifies that it is in its original condition.
LD will not accept returns or exchanges on any order specific custom-made items or made-to-order items. Order Cancellations on Custom-made items and Made-to-order items carries a 20% cancellation fee. Your checkout and  invoice will stipulate if your order is custom made or Made-to-order.

Comparison Purchasing
Very Important! To keep our prices low, we do not allow comparison purchasing. Comparison purchasing is the act of buying several of the same item, keeping the one you like best, and then returning the remainder. This causes undue restocking and inventory overhead and can be very costly.
